An Empire actor is still claiming that he is innocent despite mounting evidence.

The case around the alleged racial attack against Jussie Smollett is becoming more complicated.

It all started when Chicago police announced that they wanted to dig deeper into the story, and had requested additional information from Smollett.

However, he had been difficult to reach ever since the incident became public.

Chicago Police Superintendent Eddie Johnson says Smollett "still has the presumption of innocence and he still has his opportunity in court if he chooses to go that route."

He added: "There's a lot more evidence that hasn't been presented yet that doesn't support the version that he gave us. There's still a lot of video evidence, physical evidence, and testimony that doesn't support what he said happened."

Johnson concluded with: "I refused to characterize Jussie Smollett as a suspect unless we had concrete evidence. The 47th hour that we had those two individuals in custody is when it changed."

The main speculation going around right now is that Smollett had staged the attack together with acquaintances who posed as the “attackers.”

The incident was reportedly meant to draw attention to the celebrity.

If the allegations turn out to be true, it will mean that the intended effect was reached in the end, but the situation has backfired dramatically on Smollett.

Smollett has now been communicating with the public through his lawyers, stating that the new allegations have made him feel even more victimized.

His case is now going to be heard by a grand jury, reports indicate, although some details about the upcoming hearing remain unconfirmed.

The two implicated as potential accomplices of Smollett in the fabricated attack have been pointed out as Abimbola and Olabinjo Osundairo, both extras from Empire.
